这条法律并不经常被引用，但是所有游艇驾驶者都应对其有所了解。2004年，一名青少年酒后由于游艇发生碰撞而跌入水中被淹死，船长被判处犯有过失伤害船员的罪名。2005年，史丹岛渡轮的副船长由于服用了止痛药，在驾驶渡轮的过程中撞上了附近的一个船坞，造成11人死亡，由此这名副船长被判处有期徒刑18个月，而他的岸上主管人则被判处有期徒刑1年。如果被证明有罪，这次奥巴可能会被判处30年的有期徒刑。

大多数经常前来温彻斯特海湾的人们都认为奥巴那天夜里无权接近乌姆普夸河堤坝。因为当时太平洋上已经起了大风，12至14英尺高的巨浪凶猛地撞击着乌姆普夸河口处的沙堤，这里的海平面从50英尺上升到25英尺处。再加上当时正值退潮时期，这些巨浪的破坏力深不可测。乌姆普夸河是太平洋西北部被称为“禁区”的14条河流之一，这意味着海岸警卫队在特殊情况下可以在某一范围内禁止未经检查的船只靠岸。

在各地方区域，穿救生衣的规定也许会被轻易地拒绝，尤其是在情况比较恶劣的太平洋西北部。由于这里的情况非常恶劣，因此哥伦比亚港湾的沙坝有一个绰号叫做“太平洋墓地”。但是，当一艘旅行船在纽约乔治湖失事并且20名老年乘客遇难后，相关部门于第二年10月制定了有关救生衣的法律。就在刚刚过去的2月份当中，一艘巴尔的摩水上出租船不幸失事以后，一位来自马里兰州的代表向人们介绍了国内140法案的意义。在原始措辞中，该法案规定小孩与成年人不管是在哪一种正在行驶中的游船上都要穿救生衣。大多数人们认为该法案有些极端，立刻遭到了反对。马里兰州美国船东协会行政管理部门副总裁玛格丽特·波德里奇说：“他们要告诉人们救生衣的重要性，但是他们相信什么时候穿救生衣应该让船员们自己选择。”波德里奇帮助反对人群团结到了一起。
